US Passport Photo (skwo digit llc) is a private company and is not associated with, endorsed by, or affiliated with the United States government, the U.S. Department of State, or travel.state.gov. We are an independent service provider offering photo preparation tools.
1. Photo Ownership & Rights
You warrant that:
- You own the photo(s) you upload or have explicit permission from the photo owner to use them
- The photo(s) do not infringe on any third-party rights, including copyright, privacy, or publicity rights
- You have obtained all necessary consents for processing the photo(s), including from the person depicted
License Grant: By uploading a photo, you grant us a limited, non-exclusive license to process, resize, crop, and modify the photo solely for the purpose of providing our passport photo conversion service. You retain all ownership rights to your original photo.
2. No Guarantee of Passport Acceptance
This service is a tool only, not official approval:
- We provide automated guidance based on US Department of State passport photo requirements
- We do NOT guarantee that photos processed through our service will be accepted by the US Department of State, passport acceptance facilities, or any government agency
- The US Department of State has final and sole authority on whether to accept or reject your passport photo
- You are solely responsible for verifying that your final photo meets all official requirements before submitting your passport application
Validation errors are advisory only:
- Our automated validation checks (hat detection, lighting detection, teeth showing, etc.) are provided as guidance
- These checks may produce false positives or miss some issues
- Passing our validation does not guarantee official acceptance
- Failing our validation does not necessarily mean official rejection
Your responsibility: You must independently verify that your photo complies with official US passport photo requirements published at travel.state.gov before submitting your passport application.
3. Limitation of Liability
Service provided "AS IS":
- This service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
- We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements
- We make no warranties regarding the accuracy, reliability, or completeness of any validation results
Maximum liability: To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
No liability for:
- Rejected passport applications or photos
- Delays in passport processing
- Travel disruptions or missed travel plans
- Costs associated with retaking photos or resubmitting applications
- Indirect, incidental, consequential, or punitive damages
4. Payment Terms & Refunds
Credits:
- Our service operates on a credit-based system. One (1) credit allows you to download one (1) processed photo
- Free promotional credits expire 30 days after issuance
- Purchased credits never expire
- Credits are non-refundable once purchased
- Credits are non-transferable between accounts
No refund policy:
- All payments are final and non-refundable
- We do not provide refunds if your passport photo is rejected by the US Department of State or any passport acceptance facility
- We do not provide refunds for unused credits
- Refunds may be issued at our sole discretion in cases of technical errors or service failures
Payment processing: Payments are processed through Stripe, Inc. By making a payment, you agree to Stripe's terms of service.
5. Privacy & Data Use
Photo storage and retention:
- Uploaded photos are stored securely on our servers
- Photos are automatically deleted after 30 days unless you delete them sooner
- We do not share your photos with third parties, except as required by law or to provide the service (e.g., cloud storage providers)
- We may use anonymized photos (stripped of all personal identifiers) for research and development, including training machine learning models to improve photo quality detection and processing accuracy
Your data rights: You may request deletion of your photos and account data by contacting us at [email protected].
6. Acceptable Use Policy
Prohibited uses:
- Uploading photos depicting illegal activity
- Uploading sexually explicit, violent, or otherwise inappropriate content
- Uploading photos without proper authorization or rights
- Attempting to abuse, exploit, or reverse engineer the service
- Using the service for any unlawful purpose
Consequences: We reserve the right to suspend or terminate your account for violations of this policy, without refund.
7. Service Availability
- We do not guarantee continuous, uninterrupted access to the service
- We may modify, suspend, or discontinue the service at any time without notice
- We may perform scheduled or emergency maintenance that temporarily disrupts access
8. Age Requirement
You must be at least 18 years old to use this service. If you are under 18, you must have a parent or guardian's permission and they must agree to these Terms on your behalf.
9. Indemnification
You agree to indemnify, defend, and hold harmless US Passport Photo (skwo digit llc), its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Photos you upload to the service
10. Governing Law & Disputes
Governing law: These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
Dispute resolution: Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.
Class action waiver: You agree to resolve disputes on an individual basis only and waive any right to participate in a class action lawsuit.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the service after changes constitutes acceptance of the modified Terms. We will update the "Last Updated" date at the top of this page when changes are made.
